Mississippi Considers Statewide Ban on Online Sweepstakes Casinos

Mississippi Senator Joey Fillingane has introduced Senate Bill 2510, a proposal that aims to eliminate online sweepstakes casinos throughout the state. This measure seeks to amend the Mississippi Code of 1972, explicitly targeting online and computerized sweepstakes-style platforms.

According to the bill’s wording, “The offering for play or operating an online or interactive platform that offers for play such games within the State of Mississippi shall be deemed unlawful.” In addition to online sweepstakes, SB 2510 includes provisions to outlaw online sports pools and online racebooks.

Severe Penalties Outlined in SB 2510

The legislation establishes strict penalties for violations related to online sweepstakes casino platforms. Each violation would constitute a felony, with penalties including fines of up to $100,000 and prison sentences of up to 10 years. Additionally, entities or individuals found guilty of these violations would face asset forfeiture. This includes the seizure of any property or resources used in connection with the violations.

The location of trials for accused entities or persons will depend on where the infraction occurred or default to Hinds County. Law enforcement is also empowered to confiscate and destroy any machines or devices tied to online sweepstakes-style games. This directive includes gaming operations aboard Mississippi’s iconic riverboats.

While SB 2510 aims to eliminate online sweepstakes casinos in Mississippi, the legislation lacks clarity in its definitions. Notably, the bill does not explicitly define what constitutes “online sweepstakes casino-style games.” This ambiguity could lead to enforcement challenges if the legislation es.

Mississippi Gaming Commission Executive Director Jay McDaniel commented on the situation, stating that he considers these games unlawful. Still, the absence of a concrete definition in the bill might lead to legal disputes.

Retail gaming operations in Mississippi could be indirectly affected by SB 2510 due to its broad measures. By criminalizing these online platforms, the legislation s existing physical gaming establishments by eliminating online competition in an unregulated space.

In comparison, New Jersey is pursuing a contrasting regulatory approach. Assemblyman Clinton Calabrese recently proposed Bill A5196, seeking to regulate sweepstakes casinos and designate them as legal entities.

The New Jersey bill defines sweepstakes casinos as platforms allowing players to use free virtual currency without an initial financial commitment. Prizes include cash, credits, or other redeemable items, obtained by completing specific tasks or through chance.

Bill A5196 proposes requiring sweepstakes casinos to obtain a casino service industry enterprise license, introducing formal oversight to this gaming category. It is currently under review by the Assembly’s Tourism, Gaming, and the Arts Committee.
