Proposed Virginia Gaming Commission to Regulate Gambling Activities

The Virginia General Assembly is evaluating a proposal to establish an independent regulatory authority, the Virginia Gaming Commission (VGC), tasked with overseeing legal gambling in the state. Detailed in House Bill 2498, the legislation outlines the organizational framework, authority, and responsibilities of the VGC. If approved, the commission will provide a unified regulatory approach for the gambling industry, excluding the state lottery.

Independent Structure and Mandate

The proposed VGC would function independently, detached from The bill excludes oversight of the Virginia Lottery from the commission’s jurisdiction.

Specific eligibility criteria are established for those serving on the commission’s board and as its commissioner. These measures aim to secure impartiality and ensure that qualified professionals handle gambling regulation. Proponents of House Bill 2498 highlight that centralizing oversight under a single independent body could promote transparency, strengthen consumer protections, and fair practices within the rapidly expanding gambling market.

The bill has been assigned to the House Committee on General Laws for review. If it es the committee stage, it will proceed to the House of Delegates for further consideration.

Establishing the VGC involves restructuring the workforce by transitioning personnel from existing state agencies to the newly formed commission. House Bill 2498 also proposes multiple legal amendments to align state laws with the new regulatory framework. These include updates to key legal definitions, revisions of penalty provisions for gambling violations, and the repeal of outdated gambling-related statutes in the Virginia Code. The adjusted penalty system is designed to deter illegal gambling activities while reinforcing enforcement mechanisms.

Virginia’s gambling sector has experienced considerable growth in recent years. Following a 2020 voter referendum, several cities, including Bristol, Norfolk, and Portsmouth, approved casino developments, with construction underway at various locations. Additionally, the state legalized sports betting in 2021, permitting more than 15 operators to offer both retail and mobile options.

Despite these advancements, online casinos remain absent from Virginia’s gambling offerings. While a proposal to legalize online casino gaming was introduced this legislative session, it was quickly withdrawn by its sponsor. These developments have underscored the need for stronger regulatory systems to manage the industry’s growing complexities and consumer reach.
